Landlord's Own Use Workshop

The Workshop will provide essential information every landlord needs to know before attempting the termination of a tenancy on the grounds of Landlord’s Own Use.

Navigating the termination process for any reason can be challenging for the small, self-represented landlord. When the reason for termination is Landlord's Own Use, the landlord faces additional complexities and hurdles because this ground is frequently used inappropriately and in bad faith. A heightened awareness to the potential abuse of this reason for termination and recent legislative changes which presume bad faith mean all applications for Landlord's Own Use are closely scrutinized and require the landlord to prove the need is indeed a bona fide one and they are acting in good faith.

The Workshop will walk you through the termination process and address key topics such as the ABC's of Landlord's Own Use; Good Faith Essentials and Timing of the Notice; N12 - Notice of Termination; the LTB Hearing and Presenting Your Case; Potential Pitfalls; and Bad Faith Offences and Penalties. There will also be time allocated for Q & A.

Join the LSHC staff and special guest Jane Ferguson* as we walk you through the Landlord's Own Use termination process. The Landlord's Own Use Workshop will be streamed online via Facebook Live at www.facebook.com/landlordselfhelp.

*Jane Ferguson is a Toronto lawyer practicing primarily in the area of Administrative Law, acting primarily for residential landlords before the Landlord and Tenant Board, Small Claims and on appeals to Divisional Court. Jane has previously acted as duty counsel at the LSHC for approximately twenty years.

Landlord's Self-Help Centre is a non-profit specialty clinic funded by Legal Aid Ontario operating with a province-wide mandate to provide information and support services to the small landlord community on a non-profit basis and educate the community in landlord and tenant relations.

This is achieved through the delivery of services which include general information, referral and summary advice; providing educational programs, learning tools and material through our website (www.landlordselfhelp.com); and representing the interests of the small landlord community in law reform activities aimed at improving the regulatory environment governing residential tenancies in Ontario.

Landlord's Self-Help Centre is governed by a ten-member volunteer Board of Directors who reflect the community served and have taken an interest in the work of LSHC. The Board is comprised of members of the community and professionals who bring skills and experience to support the governance of the organization. The Centre operates with five full-time employees and assists approximately more than 16,000 clients each year.
